These Terms of Service (“Agreement” or “Terms”) are a legally binding agreement between you (the “User,” “you,” or “your”) and RAIN Platforms (“RAIN Platforms,” “we,” “us,” “our”). You acknowledge and agree that your use of the RAIN Platforms platform (the “Platform”) through RAIN Platforms’ website at https://www.tradingleagues.app/ (the “Website”) and RAIN Platforms’ mobile application (the “App”) will be governed by this Agreement, our Privacy Policy, Terms of Use, and any related terms.
Your use of our Website, App, or Platform shall constitute your acceptance of this Agreement and to all of the terms and conditions stated under this Agreement and our Privacy Policy referenced herein. PLEASE READ THE TERMS CONTAINED IN THIS AGREEMENT CAREFULLY TO ENSURE THAT YOU UNDERSTAND EACH PROVISION. PLEASE NOTE THAT THESE TERMS CONTAIN A BINDING AND MANDATORY ARBITRATION PROVISION AND CLASS ACTION/JURY TRIAL WAIVER PROVISION THAT REQUIRES THE USE OF ARBITRATION ON AN INDIVIDUAL BASIS TO RESOLVE DISPUTES, RATHER THAN JURY TRIALS OR CLASS ACTIONS AND LIMITS REMEDIES AVAILABLE TO YOU IN THE EVENT OF CERTAIN DISPUTES.
BY ACCEPTING THIS AGREEMENT, EITHER BY CLICKING A BOX INDICATING YOUR ACCEPTANCE OR BY USING AND NAVIGATING THROUGH OUR PLATFORM, WEBSITE, AND/OR APP, YOU AGREE THAT (A) YOU HAVE READ AND UNDERSTOOD THE AGREEMENT; (B) YOU REPRESENT THAT YOU ARE AT LEAST 18 YEARS OLD; (C) YOU CAN FORM A BINDING CONTRACT; AND (D) YOU ACCEPT THIS AGREEMENT AND AGREE THAT YOU ARE LEGALLY BOUND BY ITS TERMS AS WELL AS OUR PRIVACY POLICY REFERENCED HEREIN. FURTHERMORE, YOU HEREBY CONSENT TO THESE TERMS OF SERVICE, INCLUDING, WITHOUT LIMITATION, THE WAIVER OF THE RIGHT TO A TRIAL BY JURY AND/OR TRIAL BY COURT AND CONSENT TO ARBITRATE ANY CLAIM HEREWITH UNDER THE ARBITRATION CLAUSE SET FORTH HEREIN. IF YOU ARE ENTERING INTO THIS AGREEMENT ON BEHALF OF A COMPANY OR OTHER LEGAL ENTITY, YOU REPRESENT THAT YOU HAVE THE AUTHORITY TO BIND SUCH ENTITY AND ITS AFFILIATES TO THESE TERMS AND CONDITIONS, IN WHICH CASE THE TERMS “YOU” OR “YOUR” SHALL REFER TO SUCH ENTITY AND ITS AFFILIATES. IF YOU DO NOT HAVE SUCH AUTHORITY, OR IF YOU DO NOT AGREE WITH THIS AGREEMENT, YOU MUST NOT ACCEPT THIS AGREEMENT AND MAY NOT USE OUR WEBSITE, APP, OR PLATFORM. Capitalized terms not defined herein shall have the same meaning ascribed to them under our Privacy Policy.
1. Introduction
RAIN Platforms (“RAIN Platforms,” “we,” “us,” or “our”) respects the privacy of its Users (“User,” “your,” or “you”). This Privacy Policy (the “Privacy Policy”) explains how we collect, use, disclose, and safeguard your information when you use RAIN Platforms Platform (the “Platform”) through RAIN Platforms’ website at https://www.tradingleagues.app/ (the “Website”) or RAIN Platforms’ mobile application (the “App”).
RAIN Platforms is in the business of developing and providing it’s Users access to competitive gaming (each a “Game”) which allows Users to experience and learn about the financial markets. Depending on the jurisdiction, RAIN Platforms offers two categories of games:
Paid Games: Paid Games are those games where Users pay an Entry Fee, as defined in our Terms of Service, and if successful Users will be able to play and participate and win cryptocurrency in skill based Games (“Winnings”). PLAYERS RESIDING IN RESTRICTED ARES SUCH AS THE UNITED STATES WILL NOT BE ALLOWED TO PLAY PAID GAMES. Users who play Paid Games will be referred to as “Players”
Free Games: Users in certain Restricted Areas such as the United States of America will only have access to the unpaid or free version of our Games (“Free Games”). Users of Unpaid Games will not have pay any entry fee and will be ineligible to make any Winnings. The provision of such Unpaid Games are solely for entertainment and educational purposes.
RAIN Platforms is committed to protecting the privacy of its Users whose information is collected and stored while using RAIN Platforms’ Platform through our Website or App. This Privacy Policy is applicable to our Website, Platform and all applications offered for sale to the public.
The capitalized terms have the same meaning as ascribed in our Terms of Use or Terms of Service as applicable, unless otherwise noted here.
